SOME TYPICAL AFFIDAVITS AND STATUTORY DECLARATIONS

The following are examples of wording used in commonly requested Affidavits and Statutory Declarations. Similar wording, as may be applicable to you, can be typed into the body of the blank Statutory Declaration, attached hereto as a "pdf" file.

"IN THE MATTER OF"

The typical Statutory Declaration has a heading "In The Matter Of". In this part, simply say who or what the Declaration is about. For example, "In The Matter Of Jennifer Jean Smith, Born February 12, 1996", or "In The Matter Of A Lost Visa Credit Card 4520593044445555".

Taking A Child Outside The Country

  1. Joseph Adam Smith, am the husband of Lucy Maude Smith. The child, Jennifer Jean Smith, born February 12, 1996, is our daughter.

  2. My wife, Lucy Maude Smith, plans to take our daughter, Jennifer Jean Smith, on a holiday to Barbados in the period of March 3, 2002 to March 30, 2002.

  3. I consent to my daughter being taken out of the country by my wife for the aforesaid vacation.

Loss Of A Credit Card

  1. Joseph Adam Smith, born December 5, 1960, am the owner of GM Visa Credit Card No. 4520593044445555.

  2. On January 2, 2002, while on vacation at Las Vegas, Nevada, U.S.A., I used the aforesaid GM Visa Credit Card at a Texaco gas station. This is the only time I used the said credit card at Las Vegas.

  3. When I received my GM Visa statement, I noticed numerous other transactions totalling $3,562.42 also incurred in Las Vegas during the period of January 14 to 18, 2002.

  4. None of the transactions between January 14 and January 18, 2002 were authorized by me.

  5. I make this affidavit to explain that I did not incur the aforesaid charges and for no other purpose.

Witness to Signature

  1. I, Joseph Adam Smith, was personally present and did see the annexed instrument and a duplicate of it duly signed, sealed, and executed by Frederick Matthews, one of the parties to it.

  2. The instrument and duplicate were executed by Frederick Matthews at the City of Toronto in the Province of Ontario.

  3. I know the said Frederick Matthews.

  4. I am a subscribing witness to the instrument and duplicate.

Sponsoring A Foreign Relative/Visitor

  1. I, Joseph Adam Smith, born December 5, 1960, am the brother of John Peter Smith, born April 30, 1963.

  2. I have lived in Canada permanently since June 2, 1980 and currently reside at 123 Main Street, Toronto. My Social Insurance Number is 123 456 789.

  3. My brother John Peter Smith is planning to come to Canada and I am prepared to sponsor him in that I will provide him with all food and accommodation which he requires until he is able to become self-sufficient (or while he is visiting Canada).

General Commentary

We are, of course, making no warranties as to the adequacy of the examples set out above. Every situation is different, and you should attempt to state every relevant fact in separate numbered paragraphs. Frequently, there will be a specific form to be filled out (e.g., for transfer of vehicles), which should be read carefully before filling out the blank lines.
